GENERAL TERMS AND CONDITIONS

These terms and conditions (“Terms”) govern your use of our mobile application or website (“Numero eSIM”) – also referred to hereafter as the (“App”), a platform owned by Smarteletec S.L, a company registered under the laws of Spain. By accessing or using our website, App, or any of our services you agree to be bound by these Terms.

First: Service Provided

  • Description of Services: Numero eSIM is a P2P (Person to Person) communication platform, that enables the customers to obtain the services provided by the existing worldwide MNOs (Mobile Network Operators) virtually with no need for a physical SIM card. A mobile services reseller offering a wide range of mobile services for many countries including:
    • Virtual Phone Numbers: referred to as eSIM Numbers (Electronic Numbers).
      • eSIM Numbers Features: Each group of numbers comes with specific characteristics and advantages, which are clearly displayed for each number in the app before purchase. Users can review these details prior to making a payment.
      • Social media Numbers: These numbers are ranked based on their performance on social media apps, allowing customers to select a number that best suits their needs.
    • Mobile data plans for users who have eSIM (Embedded SIM) supported mobile.
    • Calling Minutes for local and international use.
    • SMS services where Numero eSIM APP enables its users to send/receive SMS locally and to any other mobile worldwide.
    • Full eSIM Profile that contains mobile data, Phone Number and Calling minutes.
  • Geographic Availability: Our services are offered to customers globally, subject to any restrictions or limitations imposed by local laws and regulations.
  • Service Limitations: All products and services are provided “as is” without warranty of any kind. We do not guarantee uninterrupted or error-free service and are not responsible for any limitations inherent in the technology or third-party networks we utilize.

Second: Account Registration

  • User Eligibility: To register for an account, you must be at least 18 years old. Registration requires the customer to directly provide the following personal information whilst agreeing to the terms & conditions:
    • Mobile number for the registration.
    • Name, ID or Passport copy and proof of address – whenever required, by the Telecom Operator or Telecom Regulatory Authority for specific countries; the phone numbers that requires ID registration are marked and indicated in the app.
    • Email address
  • Account Information: You agree to provide accurate, complete, and up-to-date information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • Account Security: You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Numero eSIM will not be liable for any loss or damage arising from your failure to comply with these obligations.

Third: Data Protection

  • Privacy Policy: We are committed to protecting your privacy. Please refer to our  Privacy Policy for information on how we collect, use, and disclose your personal data.
  • Data Collection: By using the App, you consent to the collection of certain personal information, including but not limited to your name, contact information, and payment details, as necessary for providing our services.
  • Data Security: We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction.
  • User Rights: You have the right to access, correct, or delete your personal data. Please contact us at support@numeroesim.com to exercise these rights.

Fourth: Use of the App

  • Permitted Use: You agree to use the App in compliance with all applicable laws and regulations. You shall not use the App for any unlawful, fraudulent, or malicious activities.
  • Acceptable Use of Service:
    • You agree to use the Services, Software and Websites only for purposes permitted by this Agreement as well as any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.
    • You shall not use the Service or authorize the Service to be used directly or indirectly, to transmit Inappropriate Content. Inappropriate Content includes but is not limited to unsolicited material, spam, obscene and sexually explicit material and content that violates Applicable Law, or constitutes hate directed at an individual or a group based on race, sex, national origin, religious affiliation, sexual orientation or language of such individual or group.
    • You shall not use the Service to perform unusual calling patterns inconsistent with normal, individual use, where normal use is for example, regular calls of short duration or calls to multiple numbers in a short period of time; or sending junk or bulk messages, or any other high volume multi-person calling or messaging purposes.
    • You shall not use the Service to engage in unusually high usage of the Services from individual accounts or employ any automated programs such as bots or clones (non-person-to-person communications) that may impair our ability to provide the service to other customers and/or indicate misuse of the service.
    • You are prohibited from using the Service for callback calls, auto-dialling, continuous or extensive call forwarding, telemarketing (including, without limitation, charitable or political solicitation or polling, unsolicited or unauthorized advertising or spam), fax or voicemail broadcasting or fax or voicemail blasting purposes.
    • You agree to indemnify Smarteletec S.L. against any cost and/or damage and/or expense and/or claim and/or demand, including any made by a third party, arising out of the Customer’s or End User’s use of the service in violation of the Acceptable Use of Services, and all costs relating thereto, all of which will immediately be due and payable.
    • Any attempt to do any of the foregoing is a violation of our rights. If You breach this restriction, you may be subject to prosecution and damages and we may, at our sole discretion, terminate your license and bar you from accessing the Services.
  • Prohibited Activities: You shall not engage in activities that may harm the App, its users, or its infrastructure, including but not limited to:
    • Transmitting viruses or other malicious code
    • Attempting to gain unauthorized access to the App or its systems
    • Using the App for spamming or phishing
  • Compliance with Third-Party Terms: You agree to comply with any terms and conditions imposed by third-party service providers whose services you access through the App.
  • Service Activation:
    • Phone Numbers: activation is performed automatically after assigning the phone number to the user.
    • Some of the numbers require documents due to local regulations, the number will not be activated until full registration details are provided and approved by the local regulations.
    • Calling minutes and SMS: activation is performed automatically after assigning the required recharge required for the service to work.
    • Mobile Data: Numero eSIM delivers a QR code to the user; when the user scans the QR code the eSIM profile will be downloaded and partitioned to the user mobile, the actual activation for the data occurs when the user connects to the mobile operator.
  • Mobile Data / eSIMs – Key Information:
    • You must own an eSIM supported mobile device in order to benefit from Numero eSIM mobile data service. Numero eSIM is not responsible for wrongly purchased or non-activatable purchase on a non-eSIM device after downloading the eSIM profile which takes place once the user scans the QR code; the list of eSIM supported mobile devices are displayed during purchase process; the user will also need to agree manually that he owns an eSIM supported mobile. An updated eSIM mobile devices list can be found on Numero eSIM website and mobile app; in addition, Numero eSIM offers a method provided by the local mobile operators to check if the user mobile device is supporting eSIM compatibility using USSD code.
    • It is your responsibility to make sure that your mobile device supports eSIM.
    • To activate the mobile data; You must follow activation settings provided on Numero eSIM website and/or mobile app. Numero eSIM is not responsible to refund Customer if charged for local roaming for wrongly input settings.
    • You must not delete or uninstall purchased service QR code after activation or it will permanently be lost. Numero eSIM is not responsible to refund or compensate the Customer for lost service after deletion or uninstallation.

Fifth: Purchasing and Billing

    • Pricing: All services are listed in the App and are subject to change without notice. Prices do not include taxes, which may be added at checkout.
    • Payment: You agree to pay all fees associated with your purchases in the App. We accept various forms of payment as indicated in the App.
    • Payment Conditions: Numero eSIM’s pricing display and transactions currency is EUR (€) on all official platforms.
      • The provided services have different payment terms as some of them are obliged to use the IAP (In App Purchase) and others can be purchased using payment cards, PayPal and other local payment methods.
      • Numero eSIM’s pricing display and transactions currency is EUR (€) on all official platforms.
      • It is important to follow the rules and the Terms of Use according to the used payment method.
  • Charges For Use
    • Numero eSIM states all Charges offered through IAP to be exclusive of any VAT, rather the VAT (if any) will be displayed by the relevant application store according to the Customer country rules.
    • Numero eSIM states all Charges offered through Payment Cards or any other none IAP services are inclusive of VAT, unless specified otherwise.
    • If you are reasonable and in good faith dispute an invoice or part of it, Customer shall notify Numero eSIM of such dispute within 12 days of receipt of the invoice, providing details of why the invoiced amount is incorrect and, if possible, how much the customer considers is due.
    • You shall not be entitled to set off any of its claims against claims of Numero eSIM, except where the customer’s claims are undisputed or have been confirmed by final court judgment.
  • Refund, Return, and Exchange Policy: All sales of eSIMs, mobile data packages, phone numbers, and calling plans on our website are final and non-refundable. Due to the digital nature of our products, we do not offer returns or exchanges once a purchase has been completed. Please review your order carefully before confirming your purchase.

Sixth: Customer Ownage of Service

  • You have the right of usage of the communication service immediately after purchasing it, except for those services that require the customer’s documents and identity, which are activated after providing the required documents and Numero eSIM obtaining written approval from the telecommunications company concerned with providing the service.
  • You can display, manage and activate purchased services from My Products tab on Numero eSIM website and/or app.
  • When you purchase a Subscription service; the service can be used by you during the whole purchased time depending on the Subscription which can be 1 month up to 1 year.
  • The consumable services like the calling credit should also be consumed within 1 year from the date of assigning the calling credit required for the calling minutes to work. Noting that calling bundles have a different definition for validity introduced within the app and can be validated by the user during the purchase process.
  • If you do not renew the number, it will expire from your account. Numero eSIM reserve the right to resell that number to other users or to pool it back to the mobile operator provider to be offered to other users. Numero will not be hold responsible for any loss of access to any private accounts, social media accounts or any other communication or personal channels that were linked to the number used.

Seventh: No Liability

  • Disclaimer of Warranties: Numero eSIM provides the App and its services on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the App or the information, content, materials, or products included on the App.
  • No Guarantee: We do not guarantee that the App will be available at all times, error-free.
  • The phone number ownership: A distinction must be made between the ownership of the phone number and the right to use the telecommunication services provided by the mobile or the telecom operator (Service Provider). The Service Provider is the official owner of the phone numbers and what it gives you as a user is the right to use the service after purchasing it. Both the Service Provider and/or Numero eSIM can cancel/suspend/terminate all the services or any part of it at any time without consulting the user if a wrongdoing use for the service is identified or discovered.

In such cases, neither the Service Provider nor Numero eSIM shall bear any type of direct or indirect losses caused by any service interruption.

Eighth: Limitation of Liability

  • General Limitation: In no event shall Numero eSIM, its affiliates, or their respective officers, directors, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Or to loosing any part of the services.
  • Scope of Liability: To the extent allowed by law, we disclaim all liability (whether arising from contract, negligence, or otherwise) for any loss or damage you may experience in connection with your use of the Services, including the eSIM or any Phone Number. Despite this disclaimer, Numero’s liability related to this Agreement, whether from contract, negligence, or other causes, will not exceed the amount of charges the Customer paid to Numero for the relevant Services in the 12 months preceding the event causing the liability, or €150, whichever is greater. This does not affect our liability for fraudulent misrepresentation, misrepresentation of a fundamental matter, or any other liability that cannot be excluded or limited under applicable law.

 Ninth: No Responsibility for Claims and Damages

  • Third-Party Products: Numero eSIM holds no responsibility for any claims, damages, losses, or liabilities arising from or related to the products or services of third-party providers.
  • User Responsibilities: You agree to use the services in accordance with all applicable laws and regulations. Any issues arising from the purchase, activation, or use of our services are your responsibility.

Tenth: Third-Party Services

  • Third-Party Links: The App may contain links to third-party websites or services that are not owned or controlled by Numero eSIM. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
  • No Endorsement: The inclusion of any link does not imply endorsement by Numero eSIM of the third-party website or service. You access and use these third-party websites and services at your own risk.

Eleventh: Modifications to Terms

  • Right to Modify: We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the App.
  • Notice of Changes: We will notify you of any significant changes to these Terms by posting a notice within the App or by other appropriate means.
  • Acceptance of Changes: Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

Twelfth: Governing Law

  • Applicable Law: These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles.
  • Dispute Resolution: Any disputes arising out of or related to these Terms or your use of the App shall be resolved exclusively in the courts of Spain.
